General purchase conditions

1. GENERAL

These general terms and conditions of purchase ("General Terms and Conditions") apply between you as a customer and Carrick Ledin Studio AB (hereinafter referred to as ABCM), org. no. 556932-2059, when you purchase a piece of jewelry from us via our website.

To purchase a piece of jewelry from us, you must be at least 18 years old. If you are under 18, your guardian's approval is required.

Please read the terms and conditions carefully before placing your order. By placing an order with us or accepting delivery of one of our products, you accept these terms and conditions. To make a purchase on the website, you must be over 18 years of age. If you are under 18, the Swedish Parental Code requires the consent of a guardian.

When you shop on the website, you accept the current terms and conditions. This means that you will be bound by these terms and conditions as they were written at the time of purchase.

2. PRODUCTS

2.1 All products sold on the Site must be used in accordance with the instructions, precautions and guidelines provided with them. It is your responsibility to ensure that the products you order do not contain any substance or ingredient to which you are allergic.

2.2 All products provided through the website, including any samples, are for personal use only. Unless otherwise stated, we reserve the right to replace, discontinue or modify any products that we offer for sale or as part of a collection, without prior notice to you as a customer.

3. PRICE, ORDER & PAYMENT

3.1 Prices on the website are displayed in Swedish kronor (SEK), euros (EUR), US dollars (USD), Australian dollars (AUD), Norwegian kronor (NOK), Danish kronor (DKK), pounds sterling (GBP) depending on where you are visiting from. The prices and delivery costs displayed on the website include VAT. A delivery charge may apply but will be disclosed before the order is completed.

3.2 When ordering on the website, you add the item(s) to your shopping cart. Then you proceed to checkout by clicking on "Go to checkout" in the main menu. In checkout, you select the delivery address, delivery method and finally payment method. If you have received a discount code that you want to use, you also enter this in checkout. In order for your purchase to be completed, you must have read and accepted these general terms and conditions and our privacy policy. As a customer, you are responsible for ensuring that all information that has been filled in by you is correct. Before you complete the purchase by clicking on "Pay now", we recommend that you double-check that the information provided is correct. After placing your order, you will receive an automatically generated order confirmation via email.

3.3 We offer you as a customer a safe and secure payment solution for your purchase via bank card (VISA, Mastercard, American Express) or direct payment, invoice and partial payment via Klarna.

When paying by card, the purchase amount is deducted immediately when you place your order.

We use Shopify Payment as our payment provider.

These are PCI-compatible and thus certified level 1 PCI DSS compliant as well as 3D Secure. 3D Secure provides an extra layer of security for online credit and debit card transactions.

  • With Klarna Pay Later, Klarna Pay Now, and Klarna Split, your customers can choose to pay for their orders with a number of different options. With these payment options, customers can pay immediately, via invoice, or via installments with direct debit or credit card. With Klarna on Shopify Payments, your customers get a secure and easy checkout process.
  • Klarna Pay Later is a billing method for Shopify Payments. When you choose Klarna Pay Later as your payment method, you agree to pay for the purchase at a later time.
  • Klarna Betala Nu allows you to pay using your online banking details. Klarna Betala Nu connects to your bank account and the money is debited from your bank account immediately.

When you select Klarna Pay Now, you will be redirected to the Klarna website to pay for your order. The Klarna website will prompt you to register with your login details if you are using this payment option for the first time or to log in to your account and use your linked bank account to pay for the order.

  • With Klarna Slice It you can pay with financing. You pay the amount to be paid in installments over 6 to 36 months, with or without interest. Once you have selected Klarna Slice It, you will be redirected to Klarna's website to choose which installment you want to use to pay for your order.

Stock balance, changes, etc.

3.4 We strive to constantly have updated information about the stock balance and prices of our products.

However, after receiving your order and sending you an order confirmation, we may contact you to inform you that we cannot accept your order for the following reasons:

a) The product is out of stock or no longer available, or

b) There has been an error in the price or description of the product on the website.

If either (a) or (b) above applies, we will notify you by email. You will then be given the opportunity to accept the new terms and conditions of your order (for example, changed delivery time or adjusted price). Alternatively, you may choose to cancel the order and in such case we will not charge you for the product. If you (depending on the payment method chosen) have already paid for the product, we will refund the full amount to you as soon as possible, and no later than within 14 days.

3.5 We do our utmost to ensure that our customers have the best possible shopping experience.

To ensure a smooth and efficient process, we process orders as quickly as possible.

Once you have placed your order on the website and received our order confirmation via email, this means that your order has started to be processed and that we have started our internal preparations to be able to ship your products. We understand that sometimes there may be requests to change or modify an order. We wish we could fulfill all requests, but unfortunately we cannot accept changes to orders after the order confirmation has been sent to you. This is because our system and processes are designed to provide fast and accurate deliveries to our customers. Parts from our range are manufactured “on demand”, this means that the product is not in stock but is manufactured directly in the factory of our supplier and has a longer delivery time. These products are manufactured specifically for you and your order. We therefore ask you to carefully check your order and ensure that all information is correct before completing your purchase. If you have any questions or concerns, do not hesitate to contact our customer service. We are always available to help and answer your questions before confirming your order.

Discounts and other offers

3.6 From time to time we may offer various types of promotions and discount codes on our products and offer to send gifts with your order. Our offers are only valid during the specified time period and as long as the product is in stock and otherwise in accordance with the terms and conditions stated for the offer. Our offers cannot be combined with other discounts, or used together with gift cards, unless clearly stated on the website. Please note that in order to take advantage of an offer, you may sometimes have to enter a code at the checkout before completing your purchase.

3.7 If you return ordered products, it may mean that you no longer meet the specific terms and conditions of the offer that you used in connection with your purchase. This may mean that you either have to return any gift or can no longer receive a certain discount. If you no longer meet the terms and conditions of a given gift due to a return and do not return the gift, we will deduct its value from your refund. In addition to the above, the same terms and conditions apply to offers as for regular purchases under these general terms and conditions.

4. DELIVERY

4.1 The delivery methods available to you depend on the delivery address provided.

4.2 Delivery costs may apply, which are presented before the order is processed at checkout.

4.3 Below you will find brief information about our shipping options within Sweden.

  • PostNord consignment note (for orders under SEK 5,000)

Delivery within 2-4 working days to your home address.

  • PostNord REK Delivery Point (for orders over 5000 SEK)

When your order has been delivered to your delivery location, you will receive a notification to the phone number or email address you provided at checkout. Reminders will be sent via email or text message.

When picking up, you must present the shipment ID and valid identification. The shipment must be picked up within 7 days of the initial notification. After that, the shipment will be sent back from the delivery location and you as the customer will be charged a return shipping fee.

Varubrev includes home delivery, while REK delivers to a delivery location.

Our packages are adapted to the size of your letterbox and can in most cases be delivered directly to your letterbox, but in exceptional cases, if the package does not fit, it will be carefully placed outside your door.

Please note that in accordance with PostNord's policy, the courier will assess the safety of delivering the package or choose to return it.

Internationally:

  • Market – EU and Europe and outside Europe: International orders are delivered with trackable delivery via Fed Ex, UPS or DHL Express.

4.4 We are responsible for your order until you have physically received it. If you can see visible transport damage to the packaging or product at the time of delivery, or if the delivery does not correspond to the information in your order confirmation, you are asked to notify us by email as soon as possible. We will then investigate the situation further and in the event of an incorrect delivery, we will ensure that the correct product is sent or the amount is refunded, depending on what is agreed and possible. Any return shipping and/or delivery costs for a new item are not paid by the customer in this case.

4.5 If a delivery is not collected/received by you as a customer, it will be returned to us automatically. In the event of an automatic return, the customer will be refunded for the entire order, including any shipping costs corresponding to the cheapest shipping method available at the time of ordering. If you have chosen a shipping method other than the cheapest one offered, the difference will not be refunded. There will be a fee of SEK 400 for return shipping and other costs in connection with an automatic return. This fee will be deducted in the first place from the amount that is refunded and, if this is not possible, invoiced.

5. RIGHT OF WITHDRAWAL AND RETURN

5.1 We offer a 30-day right of withdrawal for purchases on the website. The withdrawal period begins on the day you receive your order or, in the case of a split delivery, the last part of your order. If you change your mind about your purchase, you can either return the order within the withdrawal period or notify us in writing that you wish to exercise your right of withdrawal.

5.2 The right of withdrawal does not apply to special orders and does not apply if you have used the product and/or removed any seals.

5.3 If you wish to cancel your purchase and exercise your right of withdrawal, please contact us in writing within the withdrawal period by following these steps:

a) Follow the instructions for how to complete the return here. You are responsible for the return cost and are responsible for the return until it reaches us.

b) Once we have received the return, we will issue a refund within 14 business days. We always assess the returned goods - if the product is broken, scratched, used or delayed, this will affect the refund.

5.4 In the event of a return, the customer is responsible for the goods until we receive them. You have the right to unpack and look at/examine the goods, while retaining your right of withdrawal. The goods must be handled with care and only to the extent necessary to determine the nature, properties and function of the goods. If the product is handled in excess of what is permitted or if any part of the goods is missing, you are responsible for the reduced value of the product and ABCM reserves the right to make a deduction for the reduction in value when making the refund. In order to receive a full refund of the amount you paid for the product(s) you are returning, they must be returned in their original condition, and look as they did when you received them.

All protective plastic must be left on and the product must be returned in its box. All jewelry must be returned in its original packaging.

5.6 The refund will be made via the same payment method used to pay for the purchase, unless otherwise specifically agreed.

Refunds will be made within 14 days of us receiving your notification that you wish to exercise your right of withdrawal, provided that we have received the return or proof that the return has been sent. If you have cancelled your entire order, we will refund the value of the order, minus any shipping costs.

5.7 We do not currently offer the option to make any product exchanges. If you would like a different product, you will be asked to return the ordered product and place a new order for the desired product.

6. COMPLAINT

When you make a purchase on abcmstudio.com, you have the right to complain about a product for three (3) years after receiving the product if the defect was present at the time of delivery. Defects that appear within two (2) years after delivery shall be considered a defect for which ABCM is responsible, unless ABCM shows otherwise or this is inconsistent with the nature of the product or defect.

If a complaint is approved, you are offered different options depending on the specific situation: repair or replacement of the product, refund of the money or price reduction. For a complaint to be approved, it must be justified and the defect must not have arisen due to incorrect use or other type of harmful treatment. The complaint must be made within a "reasonable time" after the defect has been discovered. If the complaint is made within two months of the defect being discovered, it is always considered to have been made within a reasonable time.

In the event of an approved complaint, it may be necessary to return the complained item. In such cases, we will send you a return label, which covers the return costs. Together with the return label, we will also send you a return form that you are asked to print, fill out and include in the return package.

8. INTELLECTUAL PROPERTY RIGHTS

The content of the website is owned by ABCM. The information is protected by marketing and intellectual property laws, which means that trademarks, company names, product names, images and graphics, design, layout, etc. may not be copied or otherwise used without written permission from ABCM.

Printing or other copying of the material is permitted for your own, private, non-commercial use. It is prohibited to copy, save or otherwise reproduce, process, modify, transfer, assign, otherwise utilize or exploit the material or parts thereof without the prior written permission of ABCM.

9. CHANGES TO TERMS

We reserve the right to make changes to the terms and conditions at any time. Changes to the terms and conditions will be posted online on the website. The changed terms and conditions are deemed to be accepted upon placing an order. Any changes will apply to all orders placed after the change has been made.

10. DISPUTE RESOLUTION

If a dispute arises between you and us, and this cannot be resolved, it will be heard in the court that follows from mandatory legislation. If you want to file a case with the Swedish National Board of Consumer Complaints (ARN), you can contact them at: Swedish National Board of Consumer Complaints, Box 174, 101 23 Stockholm or www.arn.se. In the event of a dispute that is heard by ARN, we always follow the board's recommendations.

11. FORCE MAJEURE

ABCM is exempt from sanctions for failure to fulfill certain obligations under this agreement if it is due to an aggravating circumstance as set out below and the circumstance prevents, complicates or delays fulfillment. An aggravating circumstance shall include, among others, official action or failure to act, new or amended legislation, labor conflict, blockade, fire, flood, sabotage, major accident or other type of natural disaster. Force majeure includes government decisions that negatively affect the market and products, e.g. restrictions on indications, warning texts, sales bans, etc., abnormal decline in the market and the company being subject to criminal activity that affects the business.
